GrowthOS

1. The agreement

By creating an agency on GrowthOS, or using it as part of one, you agree to these terms on behalf of your agency. If you are the person creating the account, you confirm you are allowed to agree on its behalf.

These terms work together with our Privacy Policy and our Copyright Policy.

2. Who can use GrowthOS

GrowthOS is for businesses. You must be at least 18 years old and use it for your work, on a work email address.

3. Your account and your team

Your agency’s admins decide who has access and what each person can do. Your agency is responsible for everything done through its accounts, and for removing anybody who should no longer have access.

Keep your email account secure — that is where sign-in codes are sent. If you think somebody else has got into your agency’s GrowthOS, use the Feedback tab on the right-hand edge of any GrowthOS page straight away.

4. Your data

Everything your agency puts into GrowthOS remains your agency’s. You allow us to store, process and display it only so we can run the service for you — including passing it to the providers listed in our Privacy Policy.

You are responsible for having the right to put that information into GrowthOS — including your clients’ personal information — and for telling your clients how you use it.

You can ask us for a copy of your agency’s data at any time, and when your agency stops using GrowthOS we will delete it when you ask.

5. Emails you send through GrowthOS

Proposals, follow-ups and contracts go out from your agency’s address and are your agency’s messages. You are responsible for them, and for following the laws that apply to them — such as CAN-SPAM in the United States, and PECR and GDPR in the UK and the EU.

Only email people who have a real business reason to hear from you. Do not use GrowthOS to email bought, rented or scraped lists.

To help you comply, GrowthOS puts your agency’s postal address and a link to stop follow-ups at the foot of every sales email, stops the follow-ups as soon as a client replies or asks it to, and will not send a proposal until your postal address is set in Settings.

6. AI features

AI-written work can be wrong, incomplete or unsuitable for your client. Read it before you rely on it or send it — what you send is your responsibility.

Every workspace includes a small amount of AI credit each month, and you can connect your own AI account instead. When you do, your agreement with that provider also applies, and you pay it directly.

7. Accounts you connect

If you connect another service to GrowthOS — Google Analytics, HubSpot and others — you confirm you are allowed to, and that service’s own terms apply to it. You can disconnect it at any time.

8. Acceptable use

Do not use GrowthOS to:

  • break the law, or help anybody else to;
  • upload, store or send anything you do not have the right to use;
  • send spam, or emails that are misleading about who they are from or what they are about;
  • upload malware, or anything designed to harm a computer or a person;
  • reach another agency’s information, or get around any of the service’s security or limits;
  • overload, disrupt or reverse-engineer the service, or resell it without our written agreement.

10. Price

GrowthOS is free while we onboard agencies. We will not charge you without telling you first and getting your agreement — nothing will ever start charging you automatically.

11. Changes to the service and to these terms

GrowthOS is still being built, and its features will change. If we change these terms in a way that matters, we will tell you before the change takes effect. Carrying on using GrowthOS after that means you accept the new terms.

12. Ending the agreement

You can stop using GrowthOS at any time and ask us to delete your agency’s data. We may suspend or close an account that breaks these terms or puts the service or other customers at risk — and where we reasonably can, we will warn you first.

13. No guarantee

We work hard to keep GrowthOS available, secure and correct, but it is provided “as is” and “as available”, without any promise that it will be uninterrupted, free of errors or suitable for a particular purpose.

14. Limits on our liability

As far as the law allows, we are not liable for indirect or consequential losses — such as lost profits, lost clients or lost data — and our total liability to your agency for any claim is limited to the greater of what your agency paid us in the 12 months before it, or US$100. Nothing in these terms limits any liability that the law does not allow to be limited.
